- DOJ officials issued their statement in the midst of a lawsuit filed by two Capitol police officers and 11 members of Congress alleging that Trump is liable for physical and mental injuries sustained during the Jan. 6, 2021 riot at the Capitol.
- According to the lawsuit, Trump's rally speech on January 6 "incited his supporters to commit imminent acts of violence and lawlessness at the Capitol."
- Approximately 150 Capitol police officers were injured during the insurgency, and four have since committed suicide.
- Nonetheless, the DOJ maintained that "no part of a President's official responsibilities includes the incitement of imminent private violence."
