- Nebraska has a law allowing voters to challenge a bill before it becomes law through a petition process. If opponents gather the required 125,000 signatures, Pillen's transition to a winner-take-all system would be postponed until after November's general election and could be halted altogether if a majority of voters support the referendum.
- A ballot initiative would also benefit Democrats in the 2nd District, a true swing district. If successful, it could serve as an additional motivating issue for voters who rightly oppose Trump's interference with the state's democracy for his own gain.
